This privacy policy informs you about how Materius AG, hereinafter collectively referred to as "we", "us", "our", "Materius", handles your personal data when you use our websites, platforms, portals or mobile applications (hereinafter collectively referred to as "Service") and in the context of any collaboration, to whom we may disclose your data, and what rights you have with regard to the use of your data. Materius is owned by EBP Schweiz AG, Mühlebachstrasse 11, 8032 Zurich (hereinafter the "Investor").
We always process your personal data in accordance with the applicable data protection regulations (including the Swiss Federal Act on Data Protection, “FADP”, and, where applicable, the EU General Data Protection Regulation, “GDPR”; hereinafter collectively referred to as “applicable data protection law”).
"Personal data" means any information relating to an identified or identifiable natural person or, where protected by the GDPR, a legal person. This can include, for example, your first and last name, postal address, email address, date of birth, telephone number, as well as data about your use of our website, purchases made through our portals, and your preferences. In this privacy policy, the term "your data" is also used for this purpose. Information that cannot be directly or indirectly linked to you, i.e., not to your identity, is generally not considered personal data.
“Processing” means any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

We assume no responsibility or liability for these third parties' compliance with data protection regulations and recommend that you consult the privacy policies of these third-party websites.
1. Who is responsible for processing your data?
Materius AG is responsible for the processing of your data, which is collected or received in connection with our offers or cooperation with you, or processed for other purposes as defined in this privacy policy.
2. How do we collect your data?
We collect your data directly from you or receive your data from third parties, such as affiliated companies, authorities, consultants, our service providers or from publicly accessible sources.
3. Scope, purpose and legal basis of the processing of your data
We process your data when you use our services, collaborate with us, or otherwise contact us.
We generally process your data for the following purposes:
to fulfill and process contractual or legal obligations;
to verify access authorization and manage the user account (if applicable);
for communication with you and to inform you about updates or changes to our offers or events, as well as adjustments to our terms and conditions, privacy policies, and our guidelines on how you may advertise on our portals and websites;
for combating fraud and abuse;
for developing and maintaining customer relationships;
for marketing purposes by us and third parties, i.e. all sales promotion measures, e.g. newsletters, telephone, online advertising, SMS and push notifications for market research, conducting analyses and surveys and for statistical purposes;
for the needs-based design and improvement of services;
for evaluating user behavior;
Initiation of contractual relationships with third parties;
for training purposes.
Below we have summarized in detail which data we process as part of our services, why we process it and on what legal basis we rely for this processing.
3.1 Visiting our offers (log files)
If you use our services without providing any further information, the web server technology we employ automatically logs general technical information about your visit in so-called log files. This includes, among other things, the IP address of the device used to access the site, information about the browser type, the internet service provider and the operating system used, which services were accessed on our site, referring/exit pages, and the time and duration of the visit.
The collection and processing of this information is carried out for the purpose of enabling the use of our websites (establishing a connection), ensuring and increasing the security and stability of our systems and services, analyzing the use of our services, collecting general demographic information, and enabling the optimization of our offerings, as well as for internal statistical purposes. User identification does not take place in this process. Likewise, no connection is generally established between this automatically collected information and personal data stored by us. However, the automatically collected information and personal data stored by us can be linked if you already have a registered user account on one of our portals or use certain functions of our websites as a guest, such as our contact form or our inquiry function. This linking of information can occur in order to analyze the use of our services, collect general demographic information, and enable the optimization of our online offerings.
If you send a message to a third party (for example, a material manufacturer) via a corresponding function of our portal, these messages, including their content, may be stored by us.
You can also access free services on our portal. Any personal data you provide when using a free service or in a message (email address, telephone number, etc.) may be used by us for marketing and analysis purposes (see section 3.9 below).
If your personal data is processed for the purposes described above when you visit our website, this processing is carried out in our legitimate interest to enable the use of our website (establishing a connection), to ensure and increase the security and stability of our systems and services, to analyze, statistically evaluate, adapt and improve the use of our services, and to enable the optimization of our website.
3.2 Registering a user account
For personalized services, access-protected areas, or to process requests and manage your subscriptions, registration and therefore the creation of a user account may be required. This requires the entry of certain personal data. This includes, for example:

Beyond the information marked as mandatory for using a specific service, you may voluntarily enter and save additional personal data. By confirming your data during registration for the collection and modification of your user account information, you guarantee the accuracy of the information you have entered.
We use the data for processing and administering our digital services, for verifying the plausibility of the data you enter, i.e., for establishing, defining the content of, processing, and amending the contractual relationships concluded with you via your user account, and, in the case of paid services, for proper invoicing. Accordingly, we process your data in this context in accordance with applicable data protection law.
3.3 Use of our services as registered and unregistered users
While registered users are using our services, we collect data for statistical purposes to ensure the smooth operation of the portal and to analyze and optimize our offerings and services. This includes collecting data on whether and how you use our digital services, in particular which features and advertisements you interact with. It is in our legitimate interest, in accordance with applicable data protection law, to optimize, further develop, and improve our services.
Some of our services can be used without active registration. In certain cases, a temporary user account without login is created in the background, but no user account is registered unless the user chooses to do so. This might be the case if you send a contact request via the contact form on an ad that uses the messenger function. The purpose of this process is to mirror the content of the contact request in the messenger, should you later decide to create a user account to manage your contact requests.
If you use our service as a registered user, statistical data may be visible to other registered users. Such data will only be made available to other registered users in anonymized and/or aggregated form.
3.4 Use of mobile applications
If you use our mobile applications with a mobile device, and you have enabled the transmission of your GPS signal data to third parties in your mobile device's settings, we can use GPS signal data to collect information about the location of your mobile device (latitude and longitude, horizontal accuracy).
We use location data to enhance your user experience by displaying location-based digital content (such as location-based weather information and news) via the mobile application(s) on your mobile device. We will request your consent in accordance with applicable data protection law before collecting your location data for these applications.
Even after giving your consent, you have the option to withdraw it at any time or to deactivate or object to the collection, processing, and sharing of your location data. If you do not wish to receive location-based online advertising and content, you can either deny access to your location or deactivate location services in your mobile device's settings at any time. 3.5 Purchase / Subscription to a paid offer
When you purchase a product or subscribe to a paid service, providing data such as first and last name, company name, address (full postal address, postal code, city) and possibly other data (such as billing address, payment information, etc.) is mandatory, as we need this information to process the contract with you in accordance with applicable data protection law.
When you choose an online payment option such as credit card, TWINT, or PayPal to purchase a product or paid service, payment is processed through the respective provider's online payment system. In this case, the processing of personal and payment data is handled directly by the payment system provider. We do not know or store your payment details. The privacy policies of the respective online payment system provider also apply.
We may store the data you provide when purchasing or subscribing to a paid service in your user account for future purchases/contracts, in accordance with our internal archiving and data protection policies or based on legal requirements. We use this data to optimize, improve, and further develop our services, for marketing purposes, and for statistical analysis. This may include storing all information about your current and previous purchases and contracts, such as the products, services, number of products and services per purchase, and the payment amount.
3.6 Contacting customer service or via contact form
If you contact our customer service, we may process your contact details (such as title, first and last name, telephone number, email address, or postal address) as well as the content of the conversation in order to answer your inquiry. This is in our legitimate interest, within the meaning of applicable data protection law, to provide you with expert information and to process your inquiry correctly.
Incoming and outgoing consultations with our customer service department may be recorded and stored for training and quality purposes, provided you have given your consent.
When you fill out a contact form on our website, we process the personal data you provide (such as title, first and last name, telephone number, email address or postal address, as well as the content of your inquiry). This is also in our legitimate interest to provide you with expert information and to process your inquiry correctly (in accordance with applicable data protection law).
3.7 Participation in events, prize draws or competitions (hereinafter collectively referred to as “events”)
For voluntary participation in events, we use the data you provide, such as title, first and last name, email address, postal address, and sometimes event-specific information. This data is used for organizing and conducting the events, as well as for notifying and/or publishing the winners via direct notification or on social networks. In this context, your data may also be shared in accordance with Chapter 5, for example, if we have commissioned a third party to conduct or evaluate the event, or if the event is being run by a third party through our services.
Photos and videos may be taken at events. Audio or video recordings will not be edited out afterwards. Recordings (photos and videos) will be used exclusively for our own purposes (e.g., posting on our websites, flyers, event recaps on social media, newsletters, informing participants via email, etc.).
3.8 User surveys, interviews and market research
When you voluntarily participate in a user survey, interview, or other market research activity, we collect personal data from you, such as your title, first and last name, contact details, and other information requested in the survey. We use the data you provide exclusively to improve the user experience and to further develop our products, which constitutes a legitimate interest of ours (in accordance with applicable data protection law). The survey results consist solely of aggregated and anonymized data.
3.9 Marketing and analysis purposes
By registering or placing an order as a guest through one of our services, you consent to us using your data for personalized advertising by us, our affiliated companies, third parties, and our investor. Personalized advertising includes, in particular, the personalization of advertising through digital ads on our websites and mobile applications, via email (such as emails with general information or promotional content, like newsletters), by telephone, mail, text messages, picture messages, and instant messaging services. At the end of every email we send, you will find a link to unsubscribe from the newsletter at any time. You can also unsubscribe from the newsletter at any time via the contact form (see https://www.materius.app, About Us).
We will only send you newsletters if they concern similar offers or if you have expressly consented to receive them. Otherwise, the delivery of personalized content and advertising, e.g., on our portals or those of affiliated companies, is in our legitimate interest under applicable data protection law to offer you products or services that may be of interest to you and to optimally market our offers. If prior consent is required, particularly for the processing of your data by affiliated companies or our investor, we will obtain this consent beforehand.
For this purpose, we continuously link user-specific historical and future data that we possess using various analytical tools, and analyze, aggregate, pseudonymize, and anonymize user behavior across our offerings. To improve our database, we may also use publicly available data or data from third-party providers. The insights gained from your use of our services may be used and processed within the framework of user behavior analysis by other participating companies. Such data processing is always carried out using pseudonymized or anonymized data. You can object to this processing of your data at any time by adjusting your cookie settings.
We process your data for analytical purposes, for example, to continuously improve our digital offerings and make them more user-friendly and secure. This is in our legitimate interest under applicable data protection law, to align our offerings with the needs of our customers, improve them in line with market demands, and ensure the security of our services.
By registering a user account, you are automatically subscribed to one of our newsletters, and your email address may also be used to advertise our own similar offers until you unsubscribe from the newsletter.
For the purposes described here, we may also engage data processors to handle the technical processing of advertising measures and advertising for ourselves, who will process your data exclusively for the purposes described above and on our instructions (see Chapter 5 below).
3.10 Fraud prevention, legal disputes and statutory processing obligations
We may also process your data, which we collect and process in accordance with sections 3.1 to 3.9, for fraud prevention or in the event of legal proceedings, which is in our legitimate interest under applicable data protection law to protect our business and to enforce or assert any claims we may have. We may also process your data to fulfill our legal obligations in accordance with applicable data protection law.
4 Profiling
We may automatically evaluate certain of your personal characteristics based on your data for the purposes described in Chapter 3 ("profiling"), for example, to determine preference data, identify risks of misuse and security, conduct statistical analyses, or for operational planning purposes. For the same purposes, we may also create profiles, meaning we may combine behavioral and preference data with master and contract data and technical data associated with you to better understand you as an individual with your various interests and other characteristics.
In such cases, we ensure the proportionality and reliability of the results and take measures against the misuse of these profiles or profiling. If these could have legal consequences or significant disadvantages for you, we generally conduct a manual review.
5. Disclosure of your data to third parties
We collaborate with other companies or individuals, or commission other companies or individuals to process and store data in accordance with this Privacy Policy. These may include companies of the investor, including their subsidiaries, other third parties, or data processors acting on our behalf. These third parties may have access to your personal data or usage data, but only to the extent necessary to perform the tasks commissioned by us or to fulfill the purposes described in this Privacy Policy. Disclosure of your data due to mandatory legal obligations remains reserved.
Unless a specific professional confidentiality obligation (e.g., banking secrecy) applies in a particular case, we are not subject to any professional confidentiality requirements. Please inform us if you believe that certain personal data is subject to confidentiality, so that we can review your request.
5.1 Disclosure to affiliated companies of the investor
We may share your data with EBP Schweiz AG in accordance with this Chapter 5. This sharing is for the purpose of evaluating, improving, and tailoring the products and services of our shareholders to your needs, for personalization, for marketing purposes, and for fraud and abuse prevention. Data will only be shared as described herein if legally permissible or if we have obtained your prior consent. Such consent can be revoked at any time.
5.2 Transfer to service providers
Furthermore, we will disclose your data to third parties to the extent necessary for contract processing in accordance with applicable data protection law. For this purpose, we may share the necessary data with transport companies, banks, and other service providers, such as hardware and software providers. These service providers use your data exclusively for order processing and not for any other purposes. Where necessary for the purposes mentioned in the first sentence, data may also be transferred abroad, for example, to facilitate the delivery of goods. 5.3 Disclosure to other third parties
If you click on integrated third-party offers or use integrated third-party contact forms, we may share your data as specified in the offer or contact form. We may also share your data with third parties if they wish to display personalized advertising or ads on our offers or provide you with a personalized offer. Furthermore, your data may be shared with third parties if we offer a joint deal with another third party.
To combat fraud and abuse, or in cases of suspected criminal activity, we may disclose your data to domestic and foreign law enforcement agencies and courts. If necessary, we will transfer claims to other companies, such as debt collection agencies.
Apart from the aforementioned transfer of your data, we will only transfer your data if you have expressly consented to this in accordance with applicable data protection law, if there is a legal obligation to do so, or if this is necessary to enforce our rights, in particular to enforce claims arising from the contractual relationship or to combat fraud, which constitute an overriding interest of ours.
In the event of a sale, merger, or other reorganization of some or all of our company's assets, personal data may be transferred, sold, or otherwise shared with third parties as part of that transaction or reorganization.
If we provide services in advance, for example, in the case of a purchase on account, we may, to protect our legitimate interests in concluding a contract with creditworthy customers (in accordance with applicable data protection law), obtain a credit report from a credit agency based on mathematical-statistical methods. For this purpose, we transmit the personal data required for a credit check to a credit agency and use the information received about the statistical probability of payment default to decide whether to establish, execute, or terminate the contractual relationship. The credit report may include probability values (score values) that have been calculated using scientifically recognized mathematical-statistical methods and whose calculation incorporates, among other things, contact details. Your legitimate interests are taken into account in accordance with legal provisions.
Your personal data will not be disclosed, transmitted or sold to any third parties outside of our investor unless this is necessary for the execution of a contract you have concluded with us or you have expressly consented.
6. Use of cookies, tracking and analysis tools, plug-ins and other integrations of third-party services
6.1 Cookies
Cookies help make your visit to our websites easier, more enjoyable, and more meaningful, as well as ensuring the proper functioning of our services and portals, and enabling us to provide you with interest-based advertising. Cookies are information files that your web browser automatically saves to your computer's hard drive when you visit our website. Our digital services can generally be used without accepting cookies; however, some functionalities may then be limited.

6.2 Tracking and analysis tools
Furthermore, the use of our digital services is measured and analyzed using various technical systems, primarily from third-party providers such as Google Analytics. These measurements can be anonymous or personalized. It is possible that the data collected by us or the third-party providers of such technical systems may, in turn, be passed on to third parties for processing.
For example, we use Google Analytics, a service provided by Google Inc. This means that the collected data may be transmitted to a Google server in the USA. However, IP addresses are anonymized using IP anonymization, so that they cannot be traced back to you. 6.3 Plug-ins and other integrations of third-party services

7. Transfer of personal data abroad
We may also transfer your personal data to third-party companies or commissioned service providers abroad, particularly in Europe, Asia, and the USA, provided this is necessary for the data processing described in this privacy policy. These companies or service providers are bound by the same data protection obligations as we are. If the level of data protection in a country does not correspond to that in Switzerland, we take appropriate measures to ensure that the protection of your personal data is equivalent to that in Switzerland at all times. We ensure this, for example, by concluding EU Standard Contractual Clauses or other contracts approved by the Federal Data Protection and Information Commissioner with the commissioned service providers. In exceptional cases, the transfer to countries without adequate protection may also be permissible in other circumstances, such as based on consent, in connection with legal proceedings abroad, or if the transfer is necessary for the performance of a contract.
8. How long do we store your data?
We only retain your data for as long as is legally necessary or required for the processing purpose, in particular to fulfill the order or contract and to comply with legal obligations.
When analyzing your data, we store your data until the analysis is complete or you object to further processing. If we store data based on a contractual relationship with you, this data will be stored at least as long as the contractual relationship exists and at most as long as the limitation periods for potential claims by us are running or statutory or contractual retention obligations exist.
By law, we are required to keep the contents of the contact form and the subsequent email correspondence for six months.
We then aim to anonymize the data so that we can continue to use it for statistical purposes. If this is not possible for any reason, the data will be deleted, provided that we no longer need your data for the stated processing purposes and are no longer legally obligated to retain it.
9. How do we protect your data?
We take appropriate technical and organizational precautions to diligently protect your data from loss, destruction, falsification, manipulation, or unauthorized access. We operate secure data networks that comply with the applicable technical standards. Our security measures are continuously adapted and improved in line with technological developments.
When you register with us as a user, access to your user account is only possible after entering your personal password. You should always treat payment and access information confidentially and close the browser window when you have finished communicating with us, especially if you share the computer with others.
Our employees and the service providers we commission are bound by us to secrecy and to compliance with data protection regulations.
10. What rights do you have regarding your data?
According to applicable data protection law, you have the following rights:
Right to information:
You have the right to know at any time whether and which personal data we process about you.
Right to rectification of your data:
You are entitled at any time to have your personal data corrected should you notice that we are processing incorrect data about you.
Right to erasure of your data:
If the processing of your data is no longer necessary, for example because you no longer have a contractual relationship with us or no longer consent to the processing of your data, you may request the deletion of your personal data. We will delete your personal data provided that we have no other obligation (e.g., statutory retention requirements) or overriding interest (e.g., in connection with legal proceedings or fraud prevention) to retain or process your personal data for a certain period of time.
Deleting your personal data may mean that you can no longer receive or use the services you have registered for.

Revocation of your consent:
You have the right to withdraw your consent at any time. If we receive notification that you are withdrawing your consent, we will no longer process your personal data for these specific purposes, unless there is another legitimate interest in doing so. Withdrawing your consent does not affect data processing that was carried out before the withdrawal.
Complaint to a supervisory authority:
Furthermore, you have the right to lodge a complaint regarding data processing with the competent supervisory authority, which in Switzerland is the Federal Data Protection and Information Commissioner. You can do this with the supervisory authority in your place of residence, workplace, or the location of the alleged data protection breach. You can exercise your rights at any time by sending a written notification and corresponding proof of your identity to the address below.
Please use the email account you used to register with us. This will allow us to verify your identity. We also reserve the right to verify your identity by providing a copy of your passport, a copy of the front and back of your ID card, a copy of your Swiss driver's license, or by other means. We may correspond with you regarding your request to exercise your rights.
Please note that the granting of your rights may be partially refused or restricted for legal reasons or based on data protection law. Where legally required or permitted, we will inform you of the reasons for our decision.
